According to law enforcement, on August 21 of this year a man joined a public Viber community with the aim of reporting on the CCC's activities to notify conscripts in public places and distribute summonses. On the same day, he was appointed as the community administrator.
“Law enforcement officers recorded that the man not only administered the community, but also involved other people in order for them to report on the notification measures. Specific cases are dated seven dates in the period from September 21 to October 11 of this year. On the specified days, the community informed about the work of the CCC in Polonnoye and the community”, – the statement of the OTCC and the Joint Forces reads.
Criminal proceedings against the man were opened on November 4. He was charged with obstructing the lawful activities of the Armed Forces of Ukraine and other military formations during a special period (part 1 of article 114-1 of the Criminal Code).
“The accused clearly knew and realized that the systematic posting of information about the delivery of summonses in the community impedes the lawful activities of the Armed Forces of Ukraine and other military formations during a special period. He was also aware of the socially dangerous nature of his actions, foresaw the occurrence of socially dangerous consequences regarding the provision of personnel to the Armed Forces of Ukraine and other military formations during a special period in order to undermine the defense capability of Ukraine, and desired their occurrence, since the targeted dissemination among citizens of Ukraine who are subject to military registration and conscription, of information, in particular on social networks via the Internet, about the places of actual mobilization events by military personnel [TCK] impedes their lawful activities and creates artificial obstacles to the staffing of the Armed Forces of Ukraine and other military formations”, – the court decision states.
The man entered into a plea agreement with the prosecutor. The parties agreed that he would receive five years in prison, which would be replaced by a year of probation. If he does not commit any other crimes during this time, the prison term would be considered served. Otherwise, he will have to serve a real prison sentence.
On November 22, the Polonsky District Court passed a verdict in which:
Please note that the sentence can be appealed until December 22 of this year.
During the probation period, the man will be required to periodically report to the probation agency for registration, as well as notify it of any change in place of residence, study, or work.
