In Ukraine, for the first time, copyright was registered for content created with the help of AI

In Ukraine, for the first time, certificates of copyright registration were issued for works that include images created with the help of artificial intelligence (AI).

About this reported on the website of the Ukrainian National Office of Intellectual Property and Innovation (IP office).

Among such works is the collection of images “Easter cards”, compiled by Margarita Boyko. It uses images generated by a computer program. An exhibition of these postcards was held in April 2024.

Today, the use of generative artificial intelligence is considered as a new auxiliary tool for the development of the creative industry, and not only as a threat to authors and this industry, – noted the deputy director of the IP office Lyubov Maidanyk.

Moreover In addition, they registered the copyright for Anna Khorolska's children's book “The Enchanted Adventure of Rufus”. Andrii Sitnikov's poetry collection “Poems of an Unfinished War” is also among the registered works. These editions are illustrated with AI-generated images.

If the images are created only with the help of generative artificial intelligence platforms, then no copyright arises. At the same time, the Law of Ukraine “On Copyright and Related Rights” makes it possible to define sui generis rights to such images, added Lyubov Maidanyk.

Deputy Director of the IP Office Lyubov Maidanyk noted that today generative artificial intelligence can be an auxiliary tool for the development of the creative industry, not only as a threat to authors, but also as an assistant in creating illustrations for various works.

Copyright for content

According to the legislation of Ukraine, copyright protects only images created by humans. However, Lyubov Maidanyk explained that the law of Ukraine “On copyright and related rights” provides an opportunity to define sui generis rights to AI images. At the same time, according to her, copyright protection applies only to that part created by man.
