The delivery of a summons cannot be challenged in court, and failure to appear on a summons to The TCC is punishable by an administrative fine or criminal liability.
In case of failure to arrive at the TCC upon summons to clarify data or undergo a medical examination, the person faces an administrative fine in the amount of:
– for the first violation from 100 to 200 of the tax-free minimum income of citizens (1700 – 3400 UAH);
– in case of repeated violation during the year from 200 to 500 tax-free minimum income of citizens (3,400 – 8,500 UAH).
Administrative fine for failure to appear on a summons or violation of the rules of military registration is assigned by the head of the TCC, but for this the person must personally to appear at the TCC.
A person receives a receipt and pays a fine, after which he receives a summons and does what is required of him.
If the conscript is not showed up after passing the medical commission, receiving a summons to be drafted into the Armed Forces or a mobilization order, then he bears criminal responsibility.
According to Article 336 of the Criminal Code of Ukraine, evasion of conscription during wartime is punishable by deprivation of liberty freedom for a period of three to five years.
