In the last few minutes, a statement from the Green Oxygen Party was released announcing that they will abide by the decision issued on November 16 by the National Electoral Council to annul the expulsion of Senator Humberto de la Calle and the representative to the Chamber Daniel Carvalho, who they had been removed from the community due to differences with its founder, former presidential candidate Ingrid Betancourt.

In the statement, the community celebrates that the CNE has legally recognized them as a party of opposition to the Government of Gustavo Petro, and announce that no legal recourse will be filed against the decision to annul the expulsion of the senator and the representative.

“The Founder of the Green Oxygen Party, Ingrid Betancourt, revealed that the National Electoral Council legally recognized her community as an opposition party to the government of President Gustavo Petro. Additionally, she declared that the Green Oxygen Party fully complies with the resolution to reinstate Senator Humberto de La Calle and House Representative Daniel Carvalho, on which no type of legal recourse will be filed.”

Immediately afterwards, the communiqué breaks down Betancourt's position regarding the CNE's decision in four points. In a first point, he reiterates that no appeal will be presented before the resolution of the electoral authority, to reveal, in the second point, that he will abide by the decision, to reiterate, in the third point of the letter, that the reasons for expelling the senator and the representative remain intact, for which reason he warns them that they may incur double militancy, to, in the last point of the statement, notify them that, upon reintegration into the community, they must align themselves with the opposition and abide by the party's guidelines.

These points are reproduced below as published by the former presidential candidate:

1. The PVO will not present any appeal against the decision issued by the CNE. This is because it was the Party itself that requested verification of the expulsion process.

2.Therefore, the PVO fully abides by the CNE's decision to reinstate the Senator and the Representative.

3. Although the expulsion procedure was not accepted by the CNE, the causes that led the community to make said decision remain intact, with which the congressmen run the risk of having incurred double militancy.

4.If they rejoin the Green Oxygen Party, the congressmen must submit to the order, ratified by the CNE, to be part of the opposition bench and must abide by the party's guidelines in their congressional exercise.

CNE annuls the expulsion of Humberto de la Calle and Daniel Carvalho from the Green Oxygen party

The National Electoral Council (CNE) indicated this Wednesday, November 16, that Senator Humberto de la Calle and the representative to the Chamber Daniel Carvalho they remain linked to the Green Oxygen party. According to the decision of the Plenary Chamber, due process was not preserved when the political party expelled them in July 2022.

The CNE evaluated the presentation of magistrate César Lorduy, which assured that the Assembly of the Green Oxygen should not have made the decision of the expulsion, but the Ethics Committee of that political force, after carrying out an exhaustive analysis. In this sense, due process would not have been preserved after the congressmen declared themselves independent and not in opposition, as the political party did.

The magazine Semana was aware of the concept of the eight robes of the Plenary Chamber: “It was not evidenced that the expulsion had been generated prior to the processing of an internal sanction process.” With this verdict, the party leaders must reinstate De la Calle and Carvalho and provide them with all the guarantees for their participation in the community.

It is worth remembering that This soap opera began after Sandra Pulido Urrea, national director of Verde Oxígeno, requested on July 27 that a firm declaration be made of the expulsion of the two congressmen, which had been taken on July 16 month, warning that there was a political incompatibility between the congressmen and the party, so it would not really be a sanction. For her part, Ingrid Betancourt stated that the general assembly of Verde Oxígeno is the highest hierarchical organization, so the decision would fall to the entity.
