Supreme Court dismisses appeal for Keiko Fujimori to return to prison

The Permanent Criminal Chamber of the Supreme Court declared unfounded the appeal filed by the Lava Jato Special Team against the decision of the National Superior Chamber that admitted the appeal of Keiko Fujimori's defense and annulled her preventive detention on April 31, 2020.

The Permanent Criminal Chamber of the Supreme Court declared unfounded a fiscal appeal that sought to return former presidential candidate Keiko Fujimori to preventive detention.< /b>

Specifically, the cassation appeal filed by the Lava Jato Special Team against the decision of the National Superior Chamber that admitted the appeal of the defense of Keiko Fujimori and annulled his preventive detention on April 31, 2020 in the Odebrecht contributions case.

As reported by El Comercio, in 2020, the Prosecutor's Office indicated that the defense of The former Fuerza Popular candidate had until January 31 to appeal the 15-month preventive detention imposed on her, but the appeal was filed on February 3.

For the prosecution, the appeal against Keiko Fujimori's imprisonment should never have been admitted by the Superior Chamber because it was filed after the deadline.

The Ministry Public considers that the norm establishes three days (article 278 of the Code of Criminal Procedure), however the Chamber that freed the leader of Fuerza Popular considered that it would be five days.

The former congresswoman had already served a year with the same restrictive measure, from October 2018 to November 2019, when the Constitutional Court (TC) annulled her imprisonment for violation of personal freedom.

In January 2020, Judge Víctor Zúñiga Urday ordered Fujimori to return to preventive detention for 15 months. But after an appeal, the Judiciary ordered her release and in early May she was released from the Anexo de Mujeres de Chorrillos prison.

The former congresswoman is being investigated for the alleged crimes of money laundering and criminal organization, for the alleged receipt of illegal contributions from the construction company Odebrecht and others, in the 2011 and 2016 electoral campaigns.

The appeal of cassation is a legal instrument used in order to resolve controversies regarding the application of a norm or develop jurisprudential doctrine.
