El Comercio agreed to a judicial resolution in which it is stated that the aspiring effective collaborator CE-02-5D-FPCEDCF-2022 revealed to the Prosecutor's Office that the former Minister of Transport and Communications Juan Silva -a fugitive to date- sent a message to the businessman Zamir Villaverde -now under preventive detention- to ask him to testify before the Oversight Commission of Congress , which were unknown.

In addition, the informer has provided a bank document that would demonstrate the delivery of S/100 thousand and his relationship with the former minister.

This version appears in the minutes of the declaration of the aspiring effective collaborator dated June 2, 2022, which was sent by the anti-corruption prosecutor Karla Zecenarro to the office of the Nation's prosecutor Pablo Sánchez.

On May 27, when Silva Villegas gave his statement to the National Prosecutor's Office, he assured that “he did not know” Villaverde. However, according to the aspiring collaborator, in December 2021, when the reports linking Villaverde with President Pedro Castillo and the visits to the Pasaje Sarratea house were broadcast, Silva would have sent him the message to ask him to deny your friendship.

“In December 2021, when the report regarding Marco Villaverde García came out, where it was said that he was a friend of the President of the Republic, after the Casa de Sarratea report came out, then Minister Juan Silva sent a message to Marco Villaverde saying: Zamir, just in case you don't know me, we don't know each other, stand firm. And that is why, when they summoned the minister and Marco Villaverde to Congress, both declared that they did not know each other,” said the aspiring effective collaborator.

Silva to Villaverde, according to the statement of an aspiring collaborator: “Zamir, just in case you don't know me, we don't know each other, stand firm”

This is stated in report No. 18-2022-KZM-5D- FPCEDCFLIMA-MP-FN delivered by anti-corruption prosecutor Karla Zecenarro to Prosecutor of the Nation Pablo Sánchez, on June 3.

“In order to corroborate his version of said delivery, the effective collaborator in question provided a copy of the account statement corresponding to Current Account No. 193-2685577-0-38 (November 2021 period) of Banco de Credito del Peru, in the name of the company Estudio Villaverde SAC”, it is indicated.

As recalled, according to an audio where Zamir Villaverde and Juan Silva would talk, the businessman indicates to the former minister that he was giving him a “sign” sent by the Tapusa company; in reference to the S/100 thousand.

This delivery would have taken place on March 4 in the department of Silva, in Cercado de Lima.

Silva to Villaverde, according to the statement of an aspiring collaborator: “Zamir, just in case you don't know me, we don't know each other, stand firm”

“But Tapusa's friends have sent here, they have sent me a present for you (…) a hundred grand for you (…) It is the first one they have sent me from Tarata”, the person who according to the prosecution would be Villaverde is heard.

All this, according to the prosecution, would corroborate that on November 4, 2021 a withdrawal was made for the sum of S/100 thousand.

The prosecution, in addition, recalled that the aspiring collaborator would also have been an alleged “intermediary” of an alleged delivery of money of S/30 thousand in favor of the President of the Republic, Pedro Castillo.

< p itemprop="description" class="story-contents__font-paragraph">In addition, the aspiring collaborator told the prosecution that Silva asked him to take care of the transfer of 20 people to the Sayán district for an event.

Said statement was corroborated by the prosecution with report No. 0735-2022-MTC sent by the Ministry of Transport and Communications where it is noted that on October 16, 2021 a “mobility services commission was carried out towards the Lima Region to transfer Minister Juan Silva” on a working visit to the Sayán district, for his intervention on the Sayan-Leoncio Prado-Huaral highway.

Starost would have asked him to deny Fray Vásquez

The aspiring collaborator also included a new actor in this plot. This is the lawyer Alex Starost -whom the Commerce reported in December 2021- noting that he called Zamir Villaverde indicating that he was a lawyer for President Pedro Castillo and his nephew, Fray Vásquez.

In the communication, Starost instructed the businessman to say that he does not know Fray Vásquez. Also, that he also claims that he “lent” the vehicles to Castillo's nephew.

“I am aware that Mr. Alex Starost called Marco Villaverde García and identified himself as the president's attorney and said that he was calling on behalf of Fray Vásquez and to say that Marco Villaverde does not know Fray Vásquez,” the candidate said in his statement. /p>

When Villaverde asked the lawyer if he knew Vásquez -according to the would-be collaborator- Starost told him that his telephone number had been given to him by Fray Vásquez and He insisted that he deny that he knew the president's nephew.

Silva to Villaverde, according to the statement of an aspiring collaborator: “Zamir, just in case you don't know me, we don't know each other, stand firm”

However, the collaborator continued, before that call and after Sarratea's report, he had already spoken with Castillo's nephew with whom “he had agreed that better, Fray Vásquez would give him a sum of money of S/800 for four days of loan of a vehicle on intercalated dates”.

The prosecution indicates that Starost registers six entries to the Government Palace at the end of November and the first days December 2021, for alleged meetings with President Pedro Castillo. And, former Minister Juan Silva participated in two of these meetings.

“It is specified that in the meetings held on November 30 and December 6, 2021, the former minister and now under investigation Juan Silva Villegas”, they pointed out.

Silva ordered the presence of Starost in Provías, according to former vice minister

In his statement to the prosecution, Starost assured that he did know Silva Villegas and President Castillo and that since January 28, 2022 he had assumed the position of advisor to the former MTC minister.

He acknowledged that in the meetings at the Government Palace, among other issues, with President Pedro Castillo they discussed the Puente Tarata III Case.

In addition, he stated that at the request of the former Deputy Minister of Transport and Communications Fabiola Caballero, he went to Provías Descentralizado on December 1 and 2, 2021 to hold meetings with officials of said entity and learn about the tender that was awarded to the Termirex consortium.

However, this was denied by the former deputy minister in her witness statement that she provided to the prosecution.

And it is that, according to Caballero “he received a call from Senior Management (Juan Silva) who told him to go to the Decentralized Provías headquarters where Starost Gutiérrez was going to wait for him, in order to hold a meeting.

It was then, the former deputy minister assured, that she met Starost. He told him that he was advising the presidential office on issues of fighting corruption and that he was in charge of knowing what had happened in the process.

This is one of the first operational actions carried out by the office of the Nation's prosecutor, Pablo Sánchez, in addition to the measure of preventive detention that he requested in the first weeks of June for Silva.

According to the measure, five prosecutors participated in the operation, who arrived at the homes of Jirón Velarde No. 998 (Lince) and Jirón Pablo Bermúdez No. 143 (Cercado de Lima). “From the aforementioned elements of conviction, the need for the measures requested is inferred, since there is a high probability that there are elements of relevant conviction or effects of crime in the properties on which the request has been raised, and that run the risk of being destroyed, lost or modified, together with other possible means of evidence”, states the search resolution.

The court order also authorized prosecutors and police personnel to lift the secrecy of communications from phones, tablets, computers, laptops, USB drives, external drives and others that were seized in the operations

Silva's defense response

El Comercio contacted the lawyer Alfredo Yalán, former minister Juan Silva's lawyer, who said that he was not aware that his client had sent said message to Villaverde. He assured that, neither when they testified before Congress, nor on May 27, when they went to the Attorney General's Office, did he sponsored her mention anything about the subject.

“My client has told me at all times that he has not communicated with Mr., he has not had communication with Mr. Zamir. On May 25 we went to Congress and until then my client had not indicated to me that he had communicated with Mr. Zamir or that he had sent him any information,” he said.

Regarding the delivery of money, he affirmed that the same company Tapusa has denied any delivery of money to Villaverde and assured that they were going to present a report to the prosecutor's office to show that the tender for the Tarata III Bridge “was born dead.”

< p itemprop="description" class="story-contents__font-paragraph">“He has not communicated with me, I presume he will do so in these coming days, but we are totally incommunicado; however, for defense purposes, the attorney may submit any type of brief. But, specifically, about what you ask me about the version of the effective collaborator, the National Prosecutor's Office has not notified us at all,” he reiterated.

Former minister Juan Silva and his lawyer Alfredo Yalán at the headquarters of the Office of the Prosecutor of the Nation, on May 27, 2022.

It was collected the version of the lawyer Alex Starost, who described as “false” what was said by the aspiring effective collaborator regarding the fact that he had asked Villaverde to say that he does not know Fray Vásquez.

However, he acknowledged that he did call Villaverde, but said it was to consult him on some issues in order to define whether or not he would assume the defense of Vásquez Castillo before Congress.

“It is not false. I have not presented myself as Mr. Pedro Castillo's lawyer. What has been was the communication at the request of Mr. Fray (Vásquez) who wanted me to assume the defense before the Control Commission. So, before assuming the defense of Mr. Fray Castillo, I made the query to verify if he had rented the vehicles or had lent the vehicles to Fray. So, he (Villaverde) stated that his lawyer told him that he is renting a vehicle. So, I tell them that, if it is a loan, why not tell the truth? Faced with that, which I had doubts, I do not assume the defense before Congress, “he indicated.

The lawyer assured that, despite the fact that he refused to assume the defense of Vásquez, he took the address of his studio to include it in his request for rescheduling before the commission, without his authorization.

Silva to Villaverde, according to the statement of an aspiring collaborator: “Zamir, just in case you don't know me, we don't know each other, stand firm”

Alex Starost, who was appointed advisor to former Minister Juan Silva in January 2022, acknowledged that he called Zamir Villaverde and assured that Fray Vásquez asked him to assume his defense before Congress, but he declined said sponsorship.

He also indicated that former Vice Minister Caballero is lying when she indicates that she was not the one who summoned him, since she was the one who picked him up and took him to the meeting at the MTC with Decentralized Provías personnel.

Tapusa, through its spokespersons, indicated that the company's financial information was requested in the diligence and that it was delivered. They explained that, via a record, it was recorded that they voluntarily provided the information.

In addition, they assured that, as they explained in a statement issued days ago, they have not paid nor are they related to the businessman Villaverde.

Silva to Villaverde , according to the declaration of the aspiring collaborator:

This newspaper tried to contact the representatives of the Termirex company, but only the security of the premises attended to us. Luis Francia, lawyer for Luis Pasapera – the founder of Termirex – assured that they had given the facilities to the prosecution on the day of the raid.

“There was a raid, but they found nothing (…) they have stayed all day, there were raids before, there was no opposition and they have taken the information they wanted,” he said.
