Odessa resident sentenced to 2 years probation for Soviet symbols

A man posted posts on the social network Facebook with communist symbols. Law enforcement officers opened a case under several articles at once, as a result of which the Odessa resident received 2 years and 6 months of probation and was left without a phone.

Details of the case

In 2021, the Odessa resident took a photo against the background of a red flag and shared such a photo on Facebook, and also made and shared a composition with communist symbols for Victory Day. In addition, he distributed and publicly used a photo with the image of a red flag, in the middle of which there are images of a combination of a sickle, a hammer and a five-pointed star.

What punishment is threatened

The man was charged under clause 4 of article 436-1 of the Law of Ukraine (On the condemnation of communist and national socialist (Nazi) totalitarian regimes in Ukraine and the prohibition of propaganda of their symbols). The court decided on the basis of part 1, clause 2 of part 3 of article 76 of the Criminal Code of Ukraine to pass a sentence in the form of exemption from punishment with a probationary period of 2 years and 6 months. In addition, 14,760 hryvnias and his Redmi 8A mobile phone were recovered from the Odessa resident for the benefit of the state.
