If a taxpayer is obliged to file an income tax return but does not file it before the deadline, they will receive a penalty of between 5 and 20% depending on the delay time and the result of the declaration.

Minor offense : if the basis of the penalty is equal to or less than 3,000 euros. It carries a fine of 50%.

Serious offense : if the base of the sanction exceeds 3,000 euros and, in addition, there is concealment. The fine ranges from 50 to 100%.

Very serious offense : when the Treasury considers that fraudulent means have been used. The fine ranges from 100 to 150%.
