ECtHR obliges Russia to prevent death penalty in Donetsk

European Court of Human Rights in interim decision stated that Russia should not allow the death penalty of Moroccan citizen Brahim Saadoun, who was convicted in occupied Donetsk as a Ukrainian “mercenary”. , as well as guarantee respect for the right to life and the prohibition of inhuman or degrading treatment.

The issue of the jurisdiction of the territory where a Moroccan citizen is located is the subject of another case “Ukraine and the Netherlands v. Russia”, and until its decision, Russia is under an obligation not to interfere with individual claims to the Court.

Also, Moscow must provide the ECtHR with information within two weeks on what actions it is taking rinyala to ensure the implementation of interim measures.

The court also called on the government of Ukraine to respect the rights of Brahim Saadoun and provide all necessary information on this case within two weeks – obviously because the ECtHR has not yet established what jurisdiction the territory where the “death sentence” was passed is subject to.
