The Gatineau lawyer who challenges the curfew now claims that the sanitary measures imposed by the Legault government are also illegal.
“I am of the opinion that the government is acting illegally by governing by decree. […] I firmly believe that only the National Assembly can adopt a law governing the management of the present health crisis, ”Mr.e William Desrochers after modifying his original request to add this claim.
An action had first been filed by Mr.e Desrochers on January 18, wanting the curfew in place to be an “unreasonable” and “unjustifiable” violation of citizens’ rights.
As the court denied his urgent management request, the lawyer responded by making another request, this time for the issuance of a safeguard order.
“Settling all this politically would certainly be better than in court”, believes Me Rocks.
The case concerning the issuance of a safeguard order is to be heard this Wednesday by the Superior Court at the Gatineau courthouse.
