The trading company Breuninger from Stuttgart had submitted an urgent application to the administrative court of Baden-Württemberg in Mannheim (VGH) to open its department stores. A court spokesman confirmed this on Tuesday.
The VGH now published its decision on Thursday morning that it has rejected the application against the prohibition of its operation by the state government’s Corona ordinance.
The restrictions on infection protection are still proportionate, argued the judges in their decision.
The threat to the health of the population in Germany from the corona pandemic can still be assessed as very high overall. According to the court, this currently justifies the continuation of operating bans. It also referred to the “Click and Collect” procedure, ie the possibility for customers to pick up their ordered goods on site.
Company felt disadvantaged
The long-established company wanted to force an opening perspective under strict hygiene concepts. Breuninger had asserted interference with his property rights, considerable economic losses and problems with access to federal aid.
The company recently advertised with other companies to the federal government for an early opening.
The department store chain also criticized the, in its view, unfair capping of bridging aid from companies to 750 million euros in annual sales. However, this exclusion of large companies should no longer apply, as it became known on Wednesday.

Kretschmann promises opening of the retail trade
Meanwhile, a glimmer of hope for the retail sector emerged on Wednesday. Baden-Württemberg’s Prime Minister Winfried Kretschmann (Greens) promised an early reopening – if the incidence number reached 35 and kept stable. According to Kretschmann, model calculations show that Baden-Württemberg could be the first federal state to achieve this value. “Possibly towards the end of next week,” said Kretschmann.
