    Benji Espinoza, lawyer for the President of the Republic, Pedro Castillo, referred to the rumors about the possible preliminary arrest of the first lady Lilia Paredes and considered that such a measure would be “ prevaricator”.

    In statements to journalists outside the Government Palace, he indicated that Paredes Navarro has family, home and work roots, which does not represent any flight risk for justice.

    “I have said it and I ratify it now: a measure of this nature would be prevaricating because a preliminary arrest has to be based on the possibility of escape according to law. The question is: what chance of escape does the first lady have? If you want to look for it, you can find it here; when they raided her residence they found her; she wanted collaboration, she allowed them to enter her room; What's more, he presented a bench, he took out a chair so that the agents can check if Yenifer was there or some of her assets”, he said.

    “There is collaboration, home roots as well, family roots, does anyone doubt that the first lady has an established family, that she lives with the president and her two minor children? Does anyone doubt that she has a well-known job as the first lady of the Republic? She has family roots, home and work. What risk of escape would it represent?”, he added.

    In that sense, Espinoza considered that preventive detention is an “bad practice” of the prosecution, but it does not imply that the person is guilty, since “it is not a punishment” or an “anticipated sentence”, but a measure to protect flight risk or a risk of obstruction.

    Regarding the possible request for preventive detention for 36 months against Yenifer Paredes, sister-in-law of Pedro Castillo, the lawyer clarified that it would not be appropriate to support a request of this nature because it does not comply with with the requirements established by law.

    “I am not Yenifer's lawyer, but I would say that from a strictly legal point of view, It would not correspond to protect a request of this nature, it does not comply with the requirements of the law. Article 268 of the Criminal Procedure Law is clear: either all the requirements are met or there is no imprisonment”, he stressed.

    “First requirement: sufficient evidence; second, sentence of more than 4 years; third, the most important, that there is procedural danger. It has already been said ad nauseam, the procedural danger is not presumed, it is proven, it is accredited and that is what is missing in the case of Yenifer Paredes ”, he sentenced.
