This Tuesday afternoon, another chapter was written in the case of the alleged crime of incompatible negotiation, whose protagonist is Agustín Lozano, former mayor of Chongoyape and current president of the Peruvian Football Federation (FPF). After the request of the Prosecutor's Office for four years in prison for the head of the sports organization, the Single-Person Temporary Criminal Court of Lambayeque finally decided to acquit him.
“Assessing the evidence and judging the facts, according to sound criticism in accordance with the principles of logic in application of Articles 2, of preliminary title 392, 393, 394, 395, 396 and 398 of the Code of Criminal Procedure, the Criminal Court of Temporary sole proprietorship in addition to functions in the crime of corruption of officials based in the province of Chiclayo, administering justice on behalf of the nation rules acquitting the accused Agustín Lozano Saavedra of the fiscal accusation in his against as perpetrator for the crime against the public administration in the incompatible negotiation modality, typified in Article 399 of the Penal Code and in the ideal concurrence of the crime against public faith in the form of ideological falsehood provided for in Article 428, first paragraph of the Penal Code, to the detriment of the Peruvian State”, said the Judge Gerardo Gálvez Rodríguez in a virtual hearing.

After announcing the verdict, the FPF head's lawyer stated that he was “agree”, while the prosecutor Cinthia Pérez Sandoval indicated that “she will wait for the corresponding notification to file the respective appeal”.
It is worth saying that the Public Ministry requested a four-year prison term for Agustín Lozano, in addition to the payment of more than 12 thousand soles and disqualification from holding public office for five years.
The origin of the process is the accusation of the representative of the Public Ministry, Cinthia Pérez Sandoval, against Lozano for irregularly signing an agreement with the Juan Aurich Sports Club, when the person involved was mayor of Chongoyape .
