The prosecutor of the Zhytomyr Regional Prosecutor's Office sent an indictment to the court against a local resident on the facts of distributing materials justifying the armed aggression of the Russian Federation against Ukraine and glorifying persons who carried out the armed aggression of the Russian Federation against Ukraine, in particular representatives of the armed formations of the Russian Federation, committed repeatedly (parts 2, 3 of Article 436-2 of the Criminal Code of Ukraine).
According to the investigation, the 59-year-old resident of Zhytomyr had been spreading pro-Russian narratives since the first months of the full-scale armed invasion of the Russian Federation.
Contrary to the law, he continued to use Russian Internet resources and, from his own page on a banned social network, distributed materials in support of the actions of the aggressor country's military.
In particular, in March 2022, he distributed a video with a group of militants of the IDF «Sparta» the so-called «DPR», which talks about the courage of pseudo-heroes-participants of the terrorist organization.
Subsequently, he repeatedly distributed materials in which he supported the combat actions of the occupiers, artillery and mortar shelling of the positions of the Armed Forces of Ukraine.
He also posted on his account a photo of a Russian serviceman with words of pride for the command of the occupiers, who are holding back the offensive of the Ukrainian defenders.
Expert studies have been conducted that confirm the defendant's involvement in the commission of crimes.
The pre-trial investigation was conducted by the USBU in the Zhytomyr region region.
The sanction of the specified article provides for a penalty – imprisonment for a term of five to eight years with or without confiscation of property.
Note: in accordance with Article 62 of the Constitution of Ukraine, a person is considered innocent of committing a crime and cannot be subjected to criminal punishment until his guilt is proven in accordance with the law and established by a court verdict of conviction.
